The indictment in this case was returned a true bill on October 8, 1895. The alleged offense was committed on May 6, 1893, in the borough of Pottstown. The commonwealth introduced evidence tending to show that the defendants rented a room for their criminal purpose, but were not usual residents of the borough; that immediately after the commission of the offense a warrant was sworn out and placed in the hands of an officer; that search was made in the vicinity, and that messages were sent to Philadelphia, Pittsburg, Reading and other places, all without result.
