The bill of indictment upon which the defendants were tried and convicted was found by the grand jury December 17, 1912. It charged a conspiracy to cheat and defraud. Assuming the alleged conspiracy was a continuing one, it could not have existed later than May 20, 1910. On that day the banking company closed its doors and the defendants thereafter performed no act which could in any way have kept alive the alleged conspiracy.
