In June, 1929, appellee instituted this suit against appellant for a divorce and the custody of his minor child. On December 29, 1930, appellee filed his first amended petition. On December 30, 1930, the cause was tried to the court and resulted in judgment being entered awarding appellee a divorce and awarding' the custody of the child to *332appellant for eight months in the year and to Mrs. S. N.
