Citizens Awareness Network (“CAN”) petitions for review of a final order and opinion of the United States Nuclear Regulatory Commission (“NRC” or “the Commission”) denying CAN’S request for an adjudicatory hearing regarding decommissioning activities taking place at the Yankee Nuclear Power Station (“Yankee NPS”). CAN’s petition for review rests on three grounds. First, CAN contends that the Commission’s order violates CAN members’ right to due process under the Fifth Amendment and § 189(a) of the Atomic Energy Act (“AEA”), 42 U.S.C. § 2239 (1988).
