Plaintiff First Financial Federal Savings & Loan Association (First Financial) appeals from the district court’s1 dismissal of its action pursuant to Federal Rule of Civil Procedure 12(b)(6) for failure to state a claim upon which relief can be granted. First Financial brought this action against E.F. Hutton Mortgage Corporation (Hutton Mortgage), Westcap Government Securities, Inc. (Westcap), and E.F. Hutton & Co., Inc.
