This i's an action for limited divorce on the ground of abandonment, under subdivision 3, section 51, article 4, title 1, chapter 8 of part 2 of the Revised Statutes. The allegation of abandonment is not contested, but the defense rests upon a denial of the marriage.
The plaintiff was examined as a witness in her own behalf, and the substance of her testimony is that she made the acquaintance of the defendant in January, 1867, while she was residing in Brooklyn with the defendant’s brother and his wife, in the capacity of nurse.
