Defendant was convicted of the crime of burglary of the first degree. He was sentenced to imprisonment for the term of ten years.
It was the theory of the prosecution that the defendant, on or about July 21, 1912, entered the office of the district attorney of Glenn County with intent to commit larceny and that he stole and took away from said office certain letters, a hotel register, and. a page which, had been torn from the register of another hotel.
