Based solely on an analysis of “whether the facts as alleged fit within any cognizable legal theory” (Leon v Martinez, 84 NY2d 83, 87-88; see also, Wiener v hazard Freres & Co., 241 AD2d 114, 120), we agree with the motion court that the complaint fails to state a claim for which relief can be granted.
