OPINION AND FINAL ORDER

REBECCA BEACH SMITH, District Judge.

This matter comes before the court on defendant’s motion for summary judgment. For the reasons articulated below, the court DENIES defendant’s motion for summary judgment based on plaintiffs failure to exhaust administrative remedies, but GRANTS summary judgment in favor of defendant on the merits of plaintiffs claim.
