.ALSCHULER, Circuit Judge.
Defendant in error Clark contracted-in writing to construct for plaintiff in error (a drainage district organized under the Illinois drainage statutes) certain ditches and levees in accordance with specifications and profiles, at the price of 13% cents per cubic yard of earth moved by Clark.
