This is an application to rehear the case of Leathers v. Gray, reported in the 96th N.C. 548. The will of Joseph Armstrong, deceased, a clause of which was interpreted in that case, was executed on 23 May, 1839, and the testator having died in the meantime, it was proven in 1840.

The following is a copy of the clause in question of this will: (163) "I also give and bequeath to my son, James W.
