HAWKINS, Judge.
— Appellant is under conviction for the murder of G. W. Lawley, with an assessed punishment of forty years in the penitentiary.
The killing occurred on the night of September 8, 1922. Mrs. Rhoda Archer, mother" of appellant, owned a house in Port Worth which she rented to deceased and a man by the name of Clements in March, 1922. Mrs. Archer had formerly lived in this house and in the latter part of August desired to resume possession and requested the parties to vacate. The Clements moved without protest.
