Appellant was convicted of the murder of Miss Emma Staley and his punishment assessed at life imprisonment.
The commencement of the indictment is: "In the name and by the authority of the State of Texas." This is in literal compliance with the statute (Art. 451 C.C.P). The Constitution, (Art. 5, sec. 12) is: ". . . The style of all writs and process shall be, `The State of Texas.' All prosecutions shall be carried on in the name and by authority of the State of Texas and shall conclude: `against the peace and dignity of the State.'"
