The appellant owns and operates, a stone quarry. The appellee was employed as a laborer to do work in and about the same. The quarry consisted of a ledge of blue stone rock which was covered with earth twelve to fifteen feet deep. It had been worked for some years, and as a result a considerable portion of the ledge and earth had been cut away from the face of the hill. The appellee, thirty-eight years of age, was a blacksmith, and had worked on a farm. He was not familiar with stone quarries, but was put to work as a laborer, doing such things as an inexperienced…
