(dissenting).. — The appeal in this case was lodged originally in Division Two, where it fell to me. My opinion reversing the judgment of the trial court was concurred in by ILcgbee, P. J. A dissent by Walker, J., brought the case to Court in Banc upon motion of respondent.

In view of the announcement in the majority opinion that the writer is “unable to conceive how any rational mind can reach any- other conclusion, except that the respondent was an officer of the Board of Equalization within the meaning of Section 12856, Revised Statutes 1919,” it cle,arly requires considerable temerity to…
