In this Miller Act suit, a subcontractor (“Gains”) is seeking to recover from the general contractor and its surety sums allegedly due under a written agreement covering a part of the work involved in the construction of enlisted men’s barracks and mess at the United States Naval Academy, Annapolis, Maryland. Essential Construction Co., Inc. (“Essential”), a New York corporation with its main office in New Jersey, was awarded the principal contract by the Bureau of Yards and Docks of the Department of the Navy.
