BASTIAN, Circuit Judge.
On December 24, 1959, we allowed an appeal from a judgment of the Municipal Court of Appeals which affirmed appellant’s conviction for simple assault but remanded the case for further proceedings.1
At his arraignment in the Municipal Court, appellant entered a plea of not guilty and asked for a jury trial. One month later, on May 18, 1959, the case came on for trial, appellant being represented by retained counsel.
