Tanya M. Oslowski filed this action in the Court of Common Pleas of Allegheny County against the Life Insurance Company of North America (“LINA”), the insurer that carried her employer’s group disability insurance policy, seeking the long tern disability benefits which the defendant had denied. LINA removed the case to this court, since Oslowski was seeking benefits due under a plan covered by the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. §§ 1001 et seq., 1132(a)(1)(B).
