May, 1887, in an action of trespass on the case for damages for negligent injury, wherein the defendant in error, Moose, was plaintiff and the Shenandoah Valley Eailroad Company was the defendant. The action was brought to recover damages for injuries received by the plaintiff while travelling as a passenger on the road of the defendant company.

The principal questions raised in this court relate to the refusal of the circuit court to give the jury certain instructions offered by the defendant. ISTo objection is made to the instructions which were given at the instance of the plaintiff; nor are they open to objection, since they literally propound the law as it has been declared by this court, and in numerous decisions of courts of last resort in England and in this country.
