This was an action in the corporation court of the city ot Lynchburg, brought under the statute, to recover damages for the alleged negligent killing of the plaintiff’s intestate by the defendant, the Virginia Midland Railway Company. The deceased was killed by being run over by a yard engine of the defendant, in its yard, within the corporate limits of Lynch-burg, on the 12tli of May, 1885.
