delivered the opinion of the Court.

Plaintiff in error was indicted in the circuit court of Tipton county at the July term, 1905, for violating the age of consent law. He was tried, convicted, and his punishment fixed at three years in the penitentiary. *61To secure a reversal of the judgment thus imposed, he has prosecuted proceedings in error to this court. The indictment on which he was tried charged that on March 20,1905, he had carnal knowledge with Ella Mauldin, a female over twelve and under eighteen years of age.
