On March 13, 1936, the plaintiff, Mrs. Maude Matteson, was a passenger on an omnibus owned and operated by the defendant, Teche Lines, Inc., having boarded the same at Thibodaux, La., for transportation to Baton Rouge, La. While proceeding on this journey, the bus ran off the highway into a ditch, at a point in the road approximately. 2 miles outside of Napoleon-ville, La., its rear right side striking a tele phone pole situated adjacent to the ditch, which caused it to be thrown forward onto the middle of the highway where it completely overturned.
