OPINION OF THE COURT
Duncan, Chief Judge:
Tried by a general court-martial convened at Fort Leavenworth, Kansas, the accused was convicted of conspiracy to commit murder and premeditated murder. He was sentenced to life imprisonment. Intermediate appellate action has resulted in approval only of findings of guilty of unpremeditated murder and a sentence to confinement at hard labor for 45 years.
