Petroneli Belskis, the defendant in error, brought this suit in the circuit court of Vermilion county against the plaintiff in error, the Dering Coal Company, to recover damages alleged to have resulted by reason of its willful failure to comply with certain provisions of the Mines and Miners act, whereby her husband, John Belskis, was killed. The trial resulted in a verdict and judgment against plaintiff in error for $1999. The Appellate Court affirmed the judgment of the lower court and the case was brought here by petition for certiorari.
