MEMORANDUM AND ORDER
VITALIANO, District Judge.
On December 6, 2004, appellee, Grace Industries, Inc. (“Grace”), filed a petition for Chapter 11 relief with the Bankruptcy Court of the Eastern District of New York. On March 8, 2005, appellant, Admiral Insurance Company (“Admiral”), filed an adversary proceeding to determine its duties under an insurance policy it had issued to the debtor. Subsequently, the parties cross-moved for summary judgment. On March 27, 2006, the bankruptcy court granted Grace’s motion for summary judgment and denied Admiral’s cross-motion.
