Southwest Aggregates, Inc. and the Alliance Insurance Company of McPherson, Kansas (“Alliance”) 1 appeal the district court’s grant of summary judgment in favor of the Texas Property and Casualty Insurance Guaranty Association 2 (the “Guaranty Association”) on the issue of the Guaranty Association’s obligation to pay a share of Southwest Aggregates’ post-1994 defense costs in a number of lawsuits involving silicosis claims.
