The only point urged in support of the demurrer, and the only question to be considered, is that pertaining to the jurisdiction of the court. The learned counsel for. *206tbe defendant argues very ingeniously, and with an industrious presentation of authorities, to show that this court has no jurisdiction of the action when the purpose is to vacate the charter or annul the existence of a private moneyed or commercial corporation.
