Appeal from a judgment of the County Court of Chemung County (Buckley, J.), rendered March 18, 2004, convicting defendant upon his plea of guilty of the crime of attempted promoting prison contraband in the first degree.
Defendant was charged with promoting prison contraband in the first degree after he allegedly was seen striking at another inmate with a shank during an altercation and a shank was then found on the floor. Defendant pleaded guilty to attempted promoting prison contraband in the first degree. Before sentencing, however, defendant moved to withdraw his plea on the ground that…
