Plaintiff alleges that he purchased a ticket and rode as a passenger on the defendant railroad from Markee to DeRidder on the morning of October 18, 1939; that when he started to leave the train at DeRidder with other passengers who were alighting and just as he reached the vestibule or platform leading to the steps, he "stepped upon some kind of foreign substance resembling a rotten orange or partially decayed banana peel which was lying directly in the middle of the passage provided for passengers to pass through in alighting from the passenger coach of the said railroad company."
