FINDINGS OF FACT AND CONCLUSIONS OF LAW

MORTON, District Judge.

In this action plaintiff challenges the final decision of the Board of Appeals and Review of the United States Civil Service Commission upholding the Tennessee Valley Authority’s termination of plaintiff in a reduction-in-force. The plaintiff contends that his termination from TVA employment was arbitrary and capricious and that the Civil Service Commission’s actions in sustaining the termination and refusing to reopen the proceedings were likewise arbitrary, capricious, and an abuse of discretion.
