Appeal from an order of Family Court, Monroe County (Kohout, J.), entered August 14, 2002, which dismissed the petition to extend placement of Vanessa Z. in foster care.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law without costs and the petition is granted.
