Plaintiff, Outboard Marine Corporation (OMC), filed a declaratory-judgment action against several insurance companies which had issued it comprehensive general liability (CGL) policies. OMC alleged that the companies breached their duty to defend it against lawsuits filed by the United States Environmental Protection Agency (USEPA) and the State of Illinois which asserted that OMC was responsible for high levels of PCB’s in Lake Michigan, one of its tributaries known as the North Ditch, and Waukegan Harbor.
