Appeal from the Circuit Court of Cook County. This was a suit in chancery commenced in the Circuit Court of Kane County, and subsequently removed into the Circuit Court of Cook County, upon change of venue.

The facts of this case are, substantially, as follows: Erasmus Woodworth and Alvin Woodworth, on the eighteenth day of November, 1859, were doing business as partners in the manufacture of wagons, on a large scale, in Aurora, in Kane County, and being much involved in debt, with a large stock of materials used in their business on hand, and other personal property, and possessed of valuable real estate in that city and elsewhere, made an assignment on that day, of all real and personal property, to two of the defendants, Russel C.
