OPINION AND ORDER DENYING DEFENDANT’S MOTION TO REMAND TO STATE COURT

ROSEN, District Judge.

I. INTRODUCTION

Defendant Edward Robinson, Jr. is charged in a June 22, 2004 indictment with possession with intent to distribute more than five grams of crack cocaine; using, brandishing, and carrying a firearm during and in relation to a drug trafficking crime; and being a felon in possession of a firearm. These charges all arise from Defendant’s alleged conduct on a single occasion in April of 2004.
