Harry Miller, as defendant, was charged in the court of common pleas of Tulsa county with the crime of unlawful possession of intoxicating liquor. A jury was waived and defendant was tried by the court, found guilty and sentenced to serve 60 days in jail, and to pay a fine of $250, and costs.

Eor reversal but one error is assigned, and being that “The court erred in overruling defendant’s motion to suppress the evidence secured by reason of the search warrant issued in this case.”

It is argued that the description contained in the search warrant was insufficient to sustain the search.
