The defendant, Verner M. Ingram, Jr., through a notice of motion dated May 28, 1976, and filed June 1, 1976, alleges that the indictment numbered 76-60 and the charges contained therein cannot be sustained upon the evidence introduced before the Grand Jury from which such *666accusatory instrument was returned, and the defendant seeks an order from this court dismissing the indictment.
