This matter is before the court on the motion of defendant City of Emporia, Kansas (Emporia) for the court to reconsider or to alter or amend its Memorandum and Order of January 5, 1990, 729 F.Supp. 747, granting summary judgment for plaintiff firefighters on the issue of Emporia’s liability for overtime compensation for the firefighters’ on-call time under the Fair Labor Standards Act, 29 U.S.C. § 207 (hereafter, the FLSA).
