This matter is before the Court on defendant’s Motion for Reconsideration or, in the Alternative, for Certification for Appeal (doc. 58). The Motion has been briefed and is ripe for disposition at this time.

I. Background.

Plaintiffs Bryan R. Gipson and Chem Technologies of Mississippi, Inc. (“Chem-Tech”) brought this patent action against defendant Mark A. Mattox pursuant to 35 U.S.C. § 256 and the Declaratory Judgment Act, 28 U.S.C. §§ 2201 et seq.
