This case arises out of claims by Barry Mendelsohn (“Mendelsohn” or the “plaintiff’) against the University Hospital, State University of New York at Stony Brook (the “Hospital”) (collectively, the “defen dants”) and Dennis Sheppard (“Sheppard”). Mendelsohn asserts that Sheppard failed to promote him in retaliation for complaints he made to his union and the Hospital regarding alleged misconduct in his department in violation of 42 U.S.C. § 1988.
