In an action to recover damages for personal *415injuries, the plaintiff appeals, as limited by his brief, from so much of (1) an order of the Supreme Court, Kings County (Shaw, J.), dated September 21, 1995, as granted that branch of the defendant’s motion which was for summary judgment dismissing the complaint, and (2) a judgment of the same court, entered November 21, 1995, as is in favor of the defendant and against him dismissing the complaint.
Ordered that the appeal from the order is dismissed; and it is further,
