BENAVIDES, Circuit Judge:

Richard Kubow appeals the district court’s grant of summary judgment. We affirm.

I. FACTUAL BACKGROUND AND PROCEDURAL HISTORY

In an instance of particularly unfortunate timing, fire struck Kubow’s music store during the early morning hours of September 27, 2003, just three days after the store’s insurance policy expired.
