OPINION
JOHN S. ANDERSON, Justice.
In this eminent domain case, the State of Texas appeals from a judgment in which the trial court (1) dismissed the State’s petition for condemnation without prejudice and (2) awarded appellees PR Investments (PRI) and Specialty Retailers, Inc., their attorneys’ fees and expenses incurred defending against the condemnation. We hold, under the eminent domain procedures set forth in the Texas Property Code chapter 21, the trial court (a) lacked jurisdiction to consider a condemnation plan not presented to the special commissioners, (b) correctly dismissed the…
