(dissenting) — On January 12, 1925, appellees executed and delivered to appellant a note secured by mortgage on real property in Boone county, Iowa. Upon default in the performance of the terms of the mortgage, appellant commenced an action on September 8, 1931, in the Boone district court for its foreclosure. On the 25th day of March, 1932, a decree, containing no unusual terms, was entered foreclosing the mortgage.
