Riner, Chief Justice.

This is a proceeding by direct appeal asking the review of a judgment of the district court of Carbon County, the assigned error which requires consideration in this court being that said judgment “is not sustained by sufficient evidence” and “is contrary to law.” The litigation was commenced in the court below through the filing there of a petition by the plaintiff Gould, for the recovery of a particularly described portion of Lot 7 in Block 27 of the Saratoga Real Estate and Improvement Company’s First Addition to the Town of Saratoga, in the County aforesaid, and also…
