This is an appeal from an order which directs the administrator-with-the-will-annexed of the estate of Francis W. Filtzer to pay to petitioner and respondent, Mary Louise Harder, a family allowance “for the support and maintenance” of Gregory Francis Filtzer, the minor child of petitioner and decedent. In challenge of the propriety of such order, there is argued: (1) the insufficiency of the evidence to sustain the application of the legitimating statute (Civ. Code, §85); and (2) the error of the trial court in awarding attorney fees in this proceeding. Neither of these points is well taken…
