Plaintiff in error, Jack Durand, was charged jointly with James Miller and Franklin Patterson, in an indictment consisting of ten counts, with the crimes of robbery, burglary, larceny and receiving stolen property. Patterson entered a plea of guilty and testified against Durand. Miller entered a plea of not guilty and appeared throughout the trial as a defendant, taking the witness stand as such, but the character of the testimony given by him indicates that he had an understanding with the prosecution that he was to testify against Durand.
