THIS MATTER comes before the Court on Defendant Santiago Hernandez’s Motion to Dismiss, Defense of Failure to State a Claim, under Rule 12(b)(6), filed February 23, 2012 (Doc. 18)(“Motion to Dismiss”). Plaintiff Francisco S. Archuleta is currently incarcerated at a federal facility in Florence, Colorado, and is proceeding pro se and in forma pauperis.
