This is an action 'on account for merchandise'sold. The suit was instituted in the court of a justice of the peace of Kaw Township,- Jackson County, Missouri, on October 7, 1929.

The defendants entered appearance and waived issuance of summons. There was a judgment for plaintiffs in the justice court and an appeal was taken to the circuit court where the case was consolidated with four similar cases and tried ele novo, upon an agreed statement of facts.
