Appeal from District Court, Jefferson County; E. A. McDowell, Judge. Action by W. M. Horwitz against the Jefferson County Traction Company. Judgment for defendant, and plaintiff appeals.

Appellant sued the appellee for damages for personal injuries, alleging negligence of the defendant as the proximate cause of his injury. Appellee is a corporation, and operates a line of electric railway between Beaumont and Port Arthur, and is a common carrier of passengers for hire. Defendant answered by general demurrer, general denial, and plea of contributory negligence on the part of plaintiff. There is no question hut that the appellant was seriously injured.
