The sole question to be determined on this appeal is whether the application of petitioner to vacate and discharge a , udgment forfeiting bail made and entered in favor of the People of the State of New York on January 31, 1923, is barred by section 598 of the Code of Criminal Procedure, as amended by chapter 478 of the Laws of 1926, which became a law on April 17, 1926, and effective July 1, 1926, and which provides as follows: “ Application for remission of forfeiture; how made and granted.
